Using Bloomb means
understanding what it is.

Bloomb is an AI-powered emotional wellness companion for mothers navigating the postpartum period. It offers a space to express how you're feeling, receive empathic AI-generated responses, and be connected to national support resources if the system detects you may be struggling.

During this MVP phase, Bloomb operates as a program with a limited number of participants. Access is by invitation or application. This is not a public app available to all.

Bloomb is operated by talktobloomb.com. When these terms refer to "Bloomb," "we," "us," or "our," that is who we mean.

To participate in Bloomb's program, you must:

• Be at least 18 years old
• Be pregnant or within the postpartum period (up to 12 months after birth)
• Reside in the United States during your participation
• Have received an invitation or been accepted through our application process
• Have the ability to read and understand these terms in English

By joining, you confirm that all of the above are true. We may end your access if we become aware that any of these conditions are not met.

Before you can use Bloomb, you complete a consent step during the join flow. These terms sit alongside that consent — they provide the legal framework for the commitments made there.

By joining Bloomb's program, you confirm that you understand and agree to:

• Bloomb is an AI, not a human. The companion you interact with is an artificial intelligence system. It is not a therapist, counsellor, or healthcare provider.
• The Safety Net operates on Bloomb's judgment, not a request. If Bloomb assesses that you may be in crisis, it will act — surfacing resources and, if you have named one, emailing your trusted contact. You do not need to ask for this. You will always be informed when it happens.
• Naming a trusted contact is optional. You can participate fully without one. If you do name a contact, they should know they may hear from Bloomb on your behalf.
• Your conversations are processed by AI. The AI providers used to generate responses (including Google Gemini and Anthropic Claude) process your conversation content. Full detail is in our Privacy Policy.
• This is a program with real obligations on both sides. You agree to use Bloomb honestly and in good faith. We agree to the commitments in Section 7 of these terms.

Bloomb provides the following to program participants:

• An AI companion for emotional expression. A private, text-based space to share how you are feeling during the postpartum period, with AI-generated responses designed to be empathic and supportive.
• Ongoing emotional check-ins. The system monitors conversation content across sessions to track how you are doing over time, not just in a single moment.
• A tiered safety monitoring system. Bloomb assesses emotional signals across four levels and responds accordingly — from gentle support at lower levels to active resource routing at higher levels. See Section 5.
• Routing to national crisis resources. When the system determines you may need immediate support, it will provide you with established national helpline numbers and, where applicable, contact your named trusted person by email.
• A record of your conversations. You can access and export your conversation history at any time. You can also request deletion.

Bloomb's safety system operates across four tiers. The AI assesses the emotional content of your conversations continuously and responds based on what it detects.

• Green — supportive. Gentle, empathic responses. Techniques such as grounding, journaling prompts, and normalising the postpartum experience.
• Yellow — attentive. More direct acknowledgement of difficulty. Encouragement to reach out to your support network. Resources surfaced in conversation.
• Orange — concerned. Sustained distress signals. Bloomb will suggest connecting with a professional and surface national resources proactively. If you have named a trusted contact, Bloomb may reach out to them by email.
• Red — immediate concern. Bloomb detects signals of crisis or acute risk. National crisis resources are surfaced immediately. If you have named a trusted contact, they will be emailed. Your conversation content is never included in that message.

When routing to national resources, Bloomb refers only to established, government-run or nationally recognised services. These are independent organisations. Bloomb does not operate them, cannot guarantee response times or outcomes, and does not endorse any specific advice they may provide.

Our Privacy Policy governs how your data is collected, processed, stored, and deleted. These terms incorporate it by reference. The key points are:

• Your conversations are processed by third-party AI providers (currently Google Gemini and Anthropic Claude) to generate responses. This is how the AI companion works.
• Your data is never sold to advertisers, insurers, employers, or any third party for commercial purposes.
• You have the right to access, export, and permanently delete your data at any time by contacting us at info@talktobloomb.com.
• Bloomb is actively working toward HIPAA compliance and is not yet fully compliant during this MVP phase. Your conversations are wellness data, not clinical records. We will communicate our compliance progress to participants.

Most terms and conditions only limit liability. We want to be explicit about what we are actually promising — not just what we're disclaiming.

We believe in being honest about what Bloomb can't do and where our responsibility ends.

• The AI can be wrong. Bloomb's AI-generated responses are not clinically validated. They may misread your emotional state, provide unhelpful suggestions, or fail to detect distress. They are not a substitute for clinical judgment.
• The safety system is not infallible. Bloomb's risk detection is based on language patterns. It can miss signals, misclassify situations, or respond in ways that do not match your actual needs. It is a safety layer, not a guarantee of safety.
• National resources are independent. Bloomb routes you to established government and national crisis services. We have no control over, and are not liable for, the quality, availability, or outcomes of those services.
• We are not liable for outcomes. If you do not engage with crisis resources provided, or if those resources are unavailable or unhelpful, Bloomb is not liable for resulting harm. Please call 911 in any life-threatening emergency.
• The program may not be right for everyone. If you are experiencing acute psychiatric symptoms, are in immediate danger, or require clinical-level care, please seek professional support rather than relying on Bloomb.

To the maximum extent permitted by law, Bloomb's total liability for any claim arising from your use of the program is limited to the amount you paid to participate (which, during this MVP phase, is zero).

Bloomb is an MVP program, not a permanent public service. We may need to pause, change, or close the program. Here is how we will handle that:

• We will give advance notice before the program closes or changes significantly. You will not wake up to find your data deleted without warning.
• You can leave at any time by contacting info@talktobloomb.com. We will confirm your exit and handle your data per our Privacy Policy.
• We may remove access if these terms are violated, if eligibility criteria are not met, or if we have reason to believe the program is being misused.
• Data at program end will be handled as described in the Privacy Policy — you will be contacted, offered export, and your data will not be retained beyond 90 days without your explicit permission.

These terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions.

If you have a dispute with Bloomb, please contact us at info@talktobloomb.com first. We will make a genuine effort to resolve it directly before either party pursues formal action.

Any legal disputes that cannot be resolved directly will be handled in the courts of North Carolina. By using Bloomb, you consent to jurisdiction there.

Continuing to use Bloomb after a notified update means you accept the revised terms. If you do not accept, you may exit the program at any time.
